Terms and Conditions

1. Scope and contract
These terms apply to contracts with Agnes Konkolewska at the address in the legal notice. An online contract is formed upon completing Stripe checkout and receiving confirmation; individual projects are formed when a written offer is accepted.
2. Personal telephone conversation
The personal telephone conversation costs €49 gross per started 30 minutes. The price is displayed by Stripe before contract formation. No specific economic, technical or personal outcome is promised. It is not legal, tax, medical or psychotherapy advice.
3. Call attempts, early termination and disruptions
The customer provides a reachable telephone number and ensures availability at the agreed time. Starting at the scheduled time, the provider will make up to three call attempts within three minutes. If all three attempts are unsuccessful, the appointment is treated as unattended and section 6 applies.
Either party may end the conversation at any time. If the customer ends it early without a reason attributable to the provider, there is no entitlement to a pro-rata refund for the reserved time, subject to mandatory statutory rights.
The provider may interrupt or end the conversation without prior warning where an important reason makes continuation unreasonable. This applies in particular to sexual harassment or sexualised or obscene remarks; racist, antisemitic, discriminatory or dehumanising statements; threats, insults, intimidation, unlawful content or recording without prior consent. Immediate termination without a warning occurs only where the circumstances and a balancing of both parties’ interests justify it.
If the conversation cannot begin or continue because of a technical failure, force majeure or another event beyond either party’s reasonable control, both parties will first make a reasonable attempt to restore the connection. If that is not possible, the unperformed part will, at the customer’s choice, be made up or refunded proportionately. If the customer culpably caused the disruption or termination, statutory payment rules apply, including mandatory rights and any required credit for saved expenses.
4. AI communication and projects
Scope, dates, fees and rights of use follow the individual offer. AI outputs may contain errors; professional review and approval remain with the customer unless otherwise agreed. Customers may provide only content they are legally entitled to use.
5. Interpreting
The fee is €69.39 net per started hour plus statutory VAT. A 150% surcharge applies on Saturdays, Sundays and statutory holidays. On-site assignments have a minimum of three started hours; outward travel, interpreting and return travel are chargeable time. Additional expenses are agreed in advance.
6. Appointments and non-attendance
Voluntary cancellation or rescheduling of confirmed appointments is excluded. Mandatory statutory rights remain unaffected. If the customer does not attend or cannot be reached despite the three call attempts described in section 3, fees remain payable in accordance with statutory rules, including any required credit for saved expenses or alternative use. If the provider cancels, a replacement date or refund is offered.
7. Payment, cooperation and liability
Online services are prepaid. Customers provide necessary information on time. Liability remains unlimited where required by law; for slight negligence affecting essential duties, liability is limited to typically foreseeable loss.
8. Withdrawal
Consumers may have a statutory withdrawal right. Starting a service before the withdrawal period ends requires express consent. The right expires only after full performance if the consumer consented to early commencement and acknowledged the consequence.
9. Governing law
German law applies, without removing mandatory consumer protection in the consumer’s country of habitual residence. Statutory jurisdiction rules remain unaffected.
In case of discrepancies, the German version applies to the extent permitted by law.
